Terms of Use
- Watch the road. Mapside helps you find the way, but traffic laws, road signs and your own judgement always come first.
- Mapside is free to use. Mapside Pro is optional, and subscriptions renew until you cancel them in your App Store or Google Play account.
- Play fair. Faking your location to earn XP is not allowed.
- Your consumer rights in your country are never reduced by these terms.
The agreement
These terms are an agreement between you and the independent developer of Mapside (“we”, “us”), whose name is shown as the seller on the App Store and Google Play. By installing or using Mapside you accept them. If you do not accept them, please do not use the app.
We give you a personal, non-exclusive, non-transferable licence to use Mapside on devices you own or control, for your own non-commercial use. How we handle your data is explained in the Privacy Policy, which is part of these terms.
You must be at least 13 years old to use Mapside, or older where your country sets a higher age for agreeing to these terms without a parent.
Safety on the road
Mapside is a guide, not a replacement for your attention.
- Always obey traffic laws, road signs, signals and directions from the police. They win over anything the app shows or says.
- Do not handle your phone while driving or riding. Set your trip before you leave, mount the phone securely, and use voice guidance, CarPlay or Android Auto on the move.
- Routes, speed limits, speed camera alerts, lane guidance, transit times and travel times come from map data and third parties. They can be wrong, missing or out of date. A suggested route may be closed, unsafe or not allowed for your vehicle.
- Walking and cycling routes can include busy roads or steep hills. Check that a route suits you before you set off.
- Exploration, levels and missions are a game layered on top of navigation. Never take risks, trespass or break rules to uncover streets or earn rewards.
Speed camera alerts are only offered where they are legal. Where local law bans them, you are responsible for turning them off.
Your account
You can use Mapside without an account. If you sign in with Apple or Google, keep access to that account safe, because whoever controls it controls your Mapside account. You can delete your account at any time as described on Delete your account.
Mapside Pro
Mapside Pro unlocks every map theme and voice pack, CarPlay and Android Auto, offline maps, your full workout history and mission insights. Everything else in Mapside is free, and map themes and voice packs you earn by levelling up stay yours if Pro ends.
- Plans. Pro is offered as a monthly or yearly subscription, or as a lifetime one-time purchase. Prices are shown in the app, in your local currency, before you buy.
- Payment. Payment is charged to your Apple ID or Google account when you confirm the purchase.
- Renewal. Subscriptions renew automatically at the same price and length unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Cancelling. Manage or cancel your subscription in your App Store account settings on iPhone, or in Google Play under Payments and subscriptions on Android. Deleting the app or your Mapside account does not cancel a subscription. After you cancel, Pro stays active until the end of the period you paid for.
- Refunds. Purchases are processed by Apple or Google, so refunds follow their rules. You can ask Apple at reportaproblem.apple.com or Google through Google Play. This does not affect any right to a refund or withdrawal you have under the law of your country.
- Restoring. Use Restore purchases in the app to unlock Pro again on a new device with the same store account.
- Price changes. If a subscription price changes, Apple or Google will tell you in advance and, where the law requires it, ask you to agree.
We may add, improve or change Pro features over time. We will not take away a core part of what you paid for during a period you have already paid for.
Fair play
When using Mapside you agree not to:
- fake, simulate or spoof your location, or use bots or automation, to uncover streets, earn XP or complete missions;
- copy, change, reverse engineer or resell the app, except where the law allows it;
- overload, scrape or attack our servers or the map services Mapside uses;
- use Mapside to break the law or to harm, track or harass anyone.
We may remove XP, rewards or progress gained by breaking these rules, and suspend accounts that keep doing it.
Map data and content
Maps, routes and place information come from OpenStreetMap contributors (© OpenStreetMap contributors, available under the Open Database License), from other open data projects and from third-party services. Transit departures, ratings, reviews and photos belong to their providers. We show them as they are and cannot guarantee they are correct or complete.
Links to other websites and services are provided for convenience. Their own terms and privacy policies apply when you use them.
Ownership
Mapside, its design, artwork, map themes, voice recordings and software belong to us or our licensors and are protected by law. These terms do not give you any rights to them beyond the licence above.
Mapside is an independent app. It is not affiliated with, endorsed by or sponsored by any game publisher or studio. Names of games, places and characters that the map themes and voice packs refer to belong to their owners and are used only to describe the style of each theme.
If you think something in Mapside infringes your rights, write to support@mapside.eu and we will look at it promptly.
Warranty and liability
We work hard to keep Mapside accurate and running, but we provide it “as is” and “as available”. To the extent the law allows, we make no promise that it will always be available, error free or right about every road, place or time.
To the extent the law allows, we are not liable for indirect or consequential losses, or for loss caused by following a route or alert that turned out to be wrong. Our total liability to you is limited to the amount you paid for Mapside Pro in the twelve months before the claim.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. If you are a consumer, you keep all the statutory rights your country gives you, including legal guarantees for digital content.
Ending the agreement
You can stop using Mapside and delete it at any time. We may suspend or end your access if you seriously or repeatedly break these terms, after warning you where we reasonably can. If we ever stop offering Mapside or Pro, we will tell you in advance.
Changes and law
We may update these terms when Mapside or the law changes. We update this page and its effective date, and we tell you in the app about changes that matter. If you keep using Mapside after a change takes effect, the new terms apply.
These terms are governed by the law of the country where the developer of Mapside is established. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts there. EU consumers can also use the European Commission's online dispute resolution information at ec.europa.eu/consumers/odr.
App Store and Google Play
If you downloaded Mapside from Apple's App Store, these points also apply:
- These terms are between you and us, not Apple. We, not Apple, are responsible for Mapside and its content.
- Apple has no duty to provide maintenance or support for Mapside.
- If Mapside fails to meet a warranty that applies to it, you can tell Apple, and Apple will refund the price you paid for the app, if any. To the extent the law allows, Apple has no other warranty obligation for Mapside.
- We, not Apple, are responsible for any claims about Mapside, including product liability claims, claims that it does not meet legal or regulatory requirements, and consumer protection claims.
- We, not Apple, are responsible for handling any claim that Mapside infringes someone's intellectual property.
- You confirm that you are not in a country under a US government embargo or named as a terrorist-supporting country, and that you are not on a US government list of prohibited or restricted parties.
- You must also follow the terms of any third-party service you use with Mapside, such as your mobile network.
- Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
If you downloaded Mapside from Google Play, the Google Play Terms of Service also apply to your purchase.
